The following terms and conditions apply to any Furnitureland South, Inc. [“FLS”] gift card issued by FLS [“Card”].
1. Privileges: |

Your right to use the funds designated on the Card is a limited right, subject to these terms and conditions and applicable law. By purchasing, accepting, retaining or using the Card, you agree to these terms and conditions, as well as future terms and conditions as amended. We reserve the right to make changes to the Card program at any time without notice. The Card and associated offers are void where prohibited by law.

2. Card Usage: |
|
The Card is not a credit card and cannot be used as one. Use of the Card is limited to the amount of funds held on the Card. The Card may only be used by customers to make purchases of merchandise from FLS on terms as set forth in the FLS Terms & Conditions sales document. To be redeemable, the card must be present at the FLS store in Jamestown , North Carolina . In the event of technical difficulties at the time of purchase using the Card, not all means of redeeming the Card may be available and FLS will provide additional instructions on the method of redemption. Except as set forth herein, you agree that you shall not use the Card elsewhere. If you attempt to use the Card at a non-participating establishment, or by non-authorized means, your purchase will be declined. Resale of this Card or use for unauthorized advertising, marketing, sweepstakes or other promotional purposes is strictly prohibited. FLS is not responsible for pricing, typographical or other errors, in any offer by FLS and reserves the right to cancel any orders resulting from or affected by such errors. The full amount of each purchase, including taxes, will be deducted from the funds held on the Card, up to the total funds available on the Card.

3. Expiration: |
|
The funds on Cards purchased by you or someone on your behalf do not expire. |

4. Promotional Cards: |
|
Promotional Cards are Cards given by FLS for free, including Cards distributed as a rebate, reward, incentive, part of a marketing program or otherwise. SPECIAL LIMITATIONS APPLY TO PROMOTIONAL CARDS. Promotional Cards may only be used toward the purchase of the following categories from FLS’s in-stock accessory inventory deemed for sale off the floor: lamps, wall art (excluding mirrors), tabletop accessories, plants and arrangements (however any item with a special order tag will be excluded). |

5. Returns: |
|
Credits for returns accepted by FLS will be allocated back to the Card. |

6. Additional Payments: |
|
It is your responsibility to know the amount of funds available on the Card at the time of purchase. To obtain fund availability information, visit www.swipeit.com. If your desired purchase amount is greater than the funds available on the card, you must use another available payment method to cover the remaining amount due. To use supplemental payment, you should instruct FLS to apply an amount not to exceed the funds available on the Card, and inform FLS that you will pay the balance by other means of payment acceptable to FLS. If for any reason a transaction is processed in spite of insufficient funds available on the Card, you agree to reimburse for the shortfall.

7. Risk of loss: |
|
The risk of loss and title for Cards pass to the purchaser upon delivery to the Cardholder or carrier, whichever is applicable. We are not responsible for lost or stolen Cards. You should keep the Card safe from loss, theft and unauthorized use. Except where required by law, Cards cannot be redeemed for cash or replaced if lost or stolen. |

8. Misuse:

If we suspect misuse of the Card, it may be suspended or terminated. We may cancel the Card at any time without notice. We may require return of the Card as a condition of reimbursement. |

9. Showroom Samples and Clearance Items

FLS AND THEIR AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS. |

10. Disputes: |
The laws of North Carolina govern the Card and these terms and conditions. Any dispute relating in any way to FLS shall be adjudicated in any state or federal court in Guilford County , North Carolina , and you consent to exclusive jurisdiction and venue in such courts. |
